Terms and Conditions of Sale
Article 1 – Purpose
These terms and conditions define the terms
governing the musical services provided
by the micro-business Anaïs La Harpiste.
Signing a quotation implies unconditional acceptance
of these terms and conditions.
Article 2 – Booking Validation
A booking is considered confirmed
upon receipt of the dated and signed quotation
by the client.
Signing the quotation constitutes
a firm reservation of the performance date.
Article 3 – Performance of Services
The performer agrees to provide the musical service
with professionalism and to the best possible standard.
The client agrees to provide all necessary information
for the smooth running of the performance
(venue, schedule, access, hosting conditions).
The performer agrees to comply with
the venue’s internal rules and safety instructions.
Article 4 – Cancellation
Cancellation by the client:
- more than 30 days before the performance: no charge
- between 30 and 7 days before the performance: 50% of the total amount remains due
- less than 7 days before the performance: 100% of the total amount remains due
These fees compensate for the reservation of the date
and the inability of the performer
to accept other engagements.
Cancellation by the performer:
In the event of force majeure (see Article 8),
a new date may be proposed whenever possible.
Article 5 – Prices
Prices are indicated in euros.
Anaïs La Harpiste operates under the French micro-business regime:
VAT not applicable, article 293 B of the French Tax Code.
Travel expenses are specified in the quotation.
Article 6 – Payment Terms
Payment may be made by bank transfer or cheque.
Invoices are payable upon receipt
and no later than 60 days
from the invoice issue date.
Article 7 – Late Payment
In the event of late payment, penalties will apply at the legal rate in force, together with a fixed compensation fee of €40 for recovery costs, in accordance with French law.
Article 8 – Force Majeure
The performer cannot be held liable
for failure to provide the service
in cases of force majeure as defined
by article 1218 of the French Civil Code,
including: unforeseen family events, illness,
accident, hospitalization, loss of voice,
or any event beyond her control
preventing the performance from taking place.
In such cases:
- the client will be informed as soon as possible
- a new date may be proposed
If rescheduling is not possible,
the performance will be cancelled
without compensation for either party.
Article 9 – Disputes
These terms and conditions
are governed by French law.
In the event of a dispute,
an amicable solution will be sought first.
Failing agreement,
the dispute may be brought before
the Commercial Court of Bordeaux.
